The act of buying any product or travel services by Luxury Holiday Trek (P.) Ltd. (hereafter referred to as The Company or through the terms of “we”, “us”, “our” and other such terms) shall be deemed form a contractual agreement between The Company and clients (hereafter referred to as The Client or through the terms of “You”, “Yours” and other such terms) under the terms and conditions mentioned below and shall represent your acceptance to such terms and conditions. The term ‘‘trip’’ is to be understood as all the trekking, tour or other packages provided or operated by The Company except for the services under the name of Other Adventures which is subject to the terms and conditions of the third parties operating the services. You are suggested to get acquainted with the latest Terms and Conditions of our company through our website.
All the information submitted to us shall be treated with utmost confidentiality and shall not be provided to other parties.
1) Booking terms and conditions
A booking is made when we have received the booking form and required deposit payment duly submitted by you in the required format and means. A binding contract will come into existence between you and The Company as soon as we have issued a booking confirmation to you and send you the details of your bookings. The booking confirmation shall be issued after the required advance booking amount has been received. The client who confirms the booking is deemed to provide us all the information in complete and accurate manner as requested by The Company. If you notice any errors and mistakes in the booking confirmation or other documents issued by us, please notify immediately as possible. Any notification of such errors and mistakes after 7 days shall harm your rights upon The Company.
A client making the booking with more than one Client named on such booking on behalf of those mentioned persons, represents and warrants to The Company that s/he or they have the required authority, have clearly communicated the Terms and Conditions and have submitted complete and accurate information about other clients on behalf of whom s/he has made the booking.
2) Accuracy on our part
We strive to ensure that the information provided on our websites are both accurate and complete; however occasional errors and changes occur and we shall reserve the right to rectify such errors as found in the website in such circumstances.
You are required to confirm the accuracy of price and other details relating to the services of packages that you wish to book, before your booking is confirmed.
3) Your Insurance, Medical conditions and other special requirements
It is a mandatory condition that you must possess travel insurance. You are advised to have the insurance covering against any pre-existing medical conditions, natural calamities, flight and trip cancellation, emergency evacuation (including helicopter evacuation and air ambulance) in case of medical emergencies at higher altitudes, loss and curtailment of luggage and personal liability. The Company has the right to cancel or suspend your participation from the booked trip at any time, with no right reserved for refund of your money, in case you are unable to provide us the proof of insurance when requested.
The Client is also advised to have proper medical checkup prior to the adventure. You are responsible for judging your own suitability and capability as well as the risks attached for a particular adventure or other activity booked with The Company. Any special conditions or limitations in mobility as well as special medical conditions must be informed in advance to The Company. Regarding the medical conditions and facilities, it is to be noted that the trek and other adventures is to the rural and underdeveloped regions where the medical facilities are not up to the standard of The Client’s native place. The company provides no medical expertise to the clients. However, we shall assist you in getting the best available medical facilities.
4) Deposit Payment
The client is required to make a non-refundable advance payment of 20% of the trip cost for Nepal packages and 40% of the Trip cost for India/Tibet/Bhutan packages, at the time of booking the trip subject to the booking terms and conditions. You are required to complete the payment no later than two months before the departure date. If you are booking for India/Tibet/Bhutan packages, the advance is to be paid 30 days prior to trip departure date and in case of booking less than 30 days full payment is to be made. The booking will be confirmed by email only after we have received the booking form and deposit amount. You are required to send us a copy of your passport or any ID along with the filled booking form.
The trips customized as per your request may have different deposit and/or full payment amount at the time of booking. The difference, if any, shall be communicated to The Client by The Company at the time of booking.
Final Payment
For Nepal packages, The Client may make the final payment upon their arrival in Nepal before the trip starts, for the trip booked by them. The payment may be made through bank transfer, cash, and traveler’s cheque or by Credit card (Visa or Master Card). If you make your payment for deposits, final balances, fringe purchases and trip extensions you are booked for a 3.5% surcharge.
For India/Tibet/Bhutan packages, the final payment is to be made 30 days prior to the trip start date.
5) Cancellation Policy
5.1) Cancellation by The Client
For Nepal Trip Cancellation and Booking Charges
If you cancel the booking of a trip, such cancellation shall come into effect after The Company receives and acknowledges the cancellation request made in writing by the Client. Such cancellation 60 days prior to the departure date shall attract the loss of deposit of The Client. While the cancellation 59-21 days prior to departure attracts 30% of cost of services booked as the cancellation charge, the cancellation with less than 21 days shall cost you 50% of the cost of services booked. The cancellation charges mentioned are expressed as a percentage of the total tour price.
In case of cancellation by The Client, in addition to the charges aforementioned, the following is also to be taken into consideration:
If you make the cancellation at the last hours prior to the beginning of the Trip, the deductions made shall include all the expenses by The Company for accommodation in hotels, taxes to the government, advance booking of other services to the suppliers and other such expenses made, which cannot be recovered by The Company from the service providers, for the purpose of providing it to The Client. Such expenses shall not be refunded to The Client.
For India/Tibet/Bhutan Trip Cancellation charge policies
You must communicate the cancellation at least 25 days prior to the trip departure in written form and such cancellation shall come into effect after the approval by The Company. A cancellation charge of 40% of the trip amount shall be deducted from the advance paid. For voluntary or involuntary cancellation of the trip or the act of leaving the trip due to any reason whatsoever, no refund shall be made to The Client.
Prevention from travelling to any country or regions owing to the Tourism Policies of the respective countries shall not attract any provision of refund, transfer or postponement of the trip. It is to be noted that Indian, Tibetan and Bhutanese authorities have strict tourism policies.
5.2) Cancellation by The Company
It is unlikely that we cancel the trip without any strong reason. However, we reserve the right to cancel your travel arrangements and trip in circumstances beyond our control. In such case you are entitled to receive the refund of trip price only. For guaranteed trips and packages, The Client is entitled for refund of trip price or an alternative trip of same value. In case of unaltered departure and arrival dates, the alternative vessels, hotel or accommodation, and modification of itinerary shall be of equivalent quality.
We are not responsible for any subsequent expenses or losses including the visas, non-refundable flight or train, loss of earnings, vaccination expenses or any other losses incurred to The Client as the result of such cancellation.
6) Changes in the Itinerary and Flight delays
The company doesn’t change the itinerary as we plan the itinerary and other travel arrangements well in advance. However, owing to certain circumstances beyond our control such as bad weather or other unforeseen circumstances, we may have to change the itinerary or accommodation while on the field or very rarely prior to the beginning of the trip or even after the trip has begun. In any such changes in the itinerary, you shall be informed as early as possible. The Company shall not refund any taxes under such circumstances due to the prior supplier arrangements.
In case of flight delay or cancellation due to bad weather, The Company shall bear the cost of accommodation (budget hotel) and food in departing city prior to your trip. However, if you have delayed flight while returning from the trip from the field, The Client is responsible for all the additional expenses including food and accommodation for alternative arrangements. In addition to that, The Company is not responsible for costs due to your missing of the international flight, but we would assist you in making alternative travel arrangements as much as possible.
7) Pricing Policies
All the trip and product prices are based on the foreign exchange rates and other expenses at the time of publication and you can expect it to be in effect at the time of departure. The prices mentioned in packages are applied per person based generally on double occupancy basis (i.e., two persons sharing a single room). For single room occupancy prior information is to be provided to us and room charges may vary for you. It is to be noted that all types of accommodation may not be available in all trips, especially when the trip is in the remote areas.
We have all the right to revise the prices mentioned in our websites and other marketing material, such as brochure, without any notice subject to the guarantees set forth as follows.
Once Luxury Holiday Trek has received your full deposit for any trip, that trip price is guaranteed and you get immunity against any price increase due to currency surcharge. Such guarantee does not include energy cost increase and/or any government tax increases.
8) Visa and Passport
You must carry a valid passport and have the required visas while you are part of the trip with Luxury Holiday Trek. Make sure that the validity of your passport is more than 6 months beyond the duration of the trip. The Company is not responsible for the denial of entry in Nepal and other places due to the lacking of proper Visa documentation.
9) Exemption of Liability
The liability of Luxury Holiday Trek is strictly limited. We shall not be responsible for any wrongdoing or negligent acts, omissions or failure to act of any suppliers including those of land, air transportation, sightseeing/excursions, hotel accommodation, or of any third party which is not directly owned or operated by Luxury Holiday Trek. By using the services of third parties, you agree to look forward to such suppliers for and accident, injury, damage or personal losses to you and Luxury Holiday Trek or any representative of Luxury Holiday Trek shall be liable for it. Similarly, The Company is not liable for any damage to person or property, loss of life, delay or inconvenience in connection with the provision of, or failure to provide, any goods or services resulting from, but not limited to natural calamities, strikes or other such labor activities or any other causes beyond direct control of Luxury Holiday Trek. We are not responsible for stolen or loss of your valuable items, failure to comply with customs regulations, any criminal or illegal activities and other such negligence of The Client.
10) Update of Terms and Conditions
The Company reserves the right to revise these terms and conditions at anytime. It is the responsibility of the Client to keep updated with any changes. The current version of terms and conditions will always be found on the website and will be the terms referred to in any dispute.
